When one or both parents want to move far enough away that it will render existing arrangements difficult or impossible, then a new agreement must be reached regarding visitation or other related issues.

When courts decide on move away orders, they typically consider many factors such as:

  • Distance the child is moving
  • Preference of the child
  • Custody time of each parent
  • Relationship of child with each parent

If the non-custodial parent objects to the move, he or she has the burden of proving why the move would be detrimental to the child.
